We successfully prosecuted a claim against a Garland, Texas homeowner whose fence defect led to the dog attack of a 10 year old

We filed a lawsuit captioned Boyer v. Estate of Laura Sue Compton, Dallas County District Court Case No. DC-17-04191 against the owner and tenants of a Garland, Texas that housed a dangerous pit bull which attacked 10 year old Jowell Boyer on March 11, 2017. The pit bull attacked 10 year old Jowell Boyer, biting his neck, arm and abdomen. The chain link fence surrounding the property housing the pit bull was in desperate need of repair. The home housing the pit bull contained no warnings about the pit bull’s presence.
The pit bull’s owner ignored repeated complaints about the pit bull escaping through fence breaches
Area residents complained to the City of Garland at least three times. They reported that the pit bull was freely roaming the neighborhood before it attacked minor Boyer. Residents also complained about the pit bull charging the fence toward pedestrian traffic. The City of Garland twice cited the residence housing the pit bull for ordinance violations. At the time, these ordinances required pit bull owners to register their pets and maintain a 6-foot wood plank fence.
The pit bull once again escaped through the dis-repaired fence and attacked Jowell on March 11, 2017
On March 11, 2017, Plaintiffs children—10 year old and his twin sister Jasmine Boyer—were lawfully playing on the patio driveway and in the alley behind their home. The pit bull presented from beneath a fence and charged Jowell and his sister. His sister jumped into a dumpster but the pit bull attacked Jowell on the alley’s surface, biting into and tearing the flesh of his head, neck and back and scratching him.
Jowell thought he was going to die while being attacked as his sister, traumatized, appreciated the incident in complete horror from inside the dumpster.
Emergency room doctors treated Jowell for bite wounds with 27 stitches and staples and bandages. Jowell and his family experienced extreme emotional distress.
