You’ve probably been approached by your own insurance company with requests do download their app. Some offer discounts for using their “good driver app”. The driving app then tracks your driving. But should you allow it?
Like you, I have a few friends who accepted their car insurance company’s offer to load a phone app. Maybe you also agreed and loaded your insurer’s app. My friends loaded their insurer’s app in exchange for an insurance discount. The app, using telematics, monitors them as they drive. But what else can your insurance company do with that data besides discounting your insurance coverage?
“Good driver” app data can be used against you
An insurer’s good driver app, through telematics technology, combines GPS tracking and onboard diagnostics to collect real-time driving data. Insurers capture the combined data and use it to make risk profile decisions about your insurance coverage.
While Police investigations assist in deciding fault, Police make it clear that insurers make final fault determinations. When available, insurers can use telematics to decide contested claims. If the adverse driver was uninsured or underinsured, the contested claim involves you and your own insurer. And your insurer will undoubtedly advantage itself in deciding to deny or diminish coverage of any tracking data secured through their app that disfavors you.
The data recorded by insurance tracking devices can reveal:
- Speeding on impact
- Sudden braking
- Erratic maneuvers
- Collision time
- Collision location
- Rapid acceleration or deceleration
Available monitoring data may also support a collision claim
For proving negligence in a personal injury claim, insurer monitoring data serves as valuable evidence. However, securing it from an adverse party may be met with a claim of insurer/insured privilege to prevent disclosure.
